False Claims

IMS Supplements, Inc. wants you to be aware of websites using alleged lab reports. These sites make claims that mislead consumers to believe that one product is better than another. Nothing in a lab report can infer better efficacy without a true clinical study comparing all of the products that are being ranked. First a lab report of any product should have a lot number of the manufactured product tested. This would clearly identify the actual product tested. Without a manufacturer's lot number - the report you are reading is useless and fake. Any manufacturer that manufactures in an FDA inspected and certified cGMP facility will not be on the website. Products manufactured in these types of facilities can easily pull the lot number and re-test and pursue legal action. The website and owners of such websites can be held legally libel for any and all false claims. You will note that all of these sites have FTC Disclosures posted in small fine print. They include statements regarding the celebrities that appear as experts are paid endorsers. Be a smart consumer and look for these disclosures.

We encourage consumers to look at not just the letter grade of a company but also the number of complaints that have been filed by consumers against a respective company when visiting the Better Business Bureau web site.

Consumer safety is what is most important. It is important to know WHO you are buying from and if they have a history or have actually received enforcement actions from the FDA. There are two very easy ways to check this. The first way is to do a search and enter " product name " and then " FDA " on the same line. Then perform the search. You can also substitute the " product name " and use the " Company Name " and then " FDA " and perform the search. If the search shows an entry from www.fda.gov then you really have to consider the integrity and honesty of the manufacturer.

Best Prostate® is quality assured and produced in a manufacturing facility in Torrance, California that is cGMP (Good Manufacturing Practices) certified by NSF (NSF is accredited by ANSI, IAS, and OSHA in the US and the Standards Council of Canada (SCC) in Canada) and the NPA (Natural Products Association). Best Prostate® undergoes the following QUALITY ASSURANCE AND QUALITY CONTROL STANDARD OPERATING PROCEDURES:

  • Quarantining all incoming raw materials immediately upon receipt from pre-qualified suppliers.
  • Subjecting the quarantined raw materials to analysis prior to their release to production.
  • Analyzing a formulation after blending a product to confirm ingredient accuracy and potency.
  • Conducting in-process inspections throughout manufacturing, including fill-weight, hardness, thickness, disintegration and friability, as well as other tests for compliance verification.
  • Visually inspecting every finished unit dose to prevent the packaging of cosmetically substandard products.
  • Quarantining finished goods until Quality Control chemists complete a final analysis and confirm that the product is correct.
  • Retaining bottled samples of each production batch by QA/QC for future reference.

There are numerous reports and pill reports and health guides regarding prostate supplements.  Unfortunately they are not reliable and for the most part receive compensation for the product that they rank as number one, two, or even three.

Previously Best Prostate was included in some of these reports with false and misleading information concerning the ingredients and specifications of IMS Supplements, Inc.’s product Best Prostate®.

Why is Best Prostate® not on these web sites? Many of these sites have been notified that IMS Supplements, Inc. takes all fraudulent representations and misleading information about the IMS Supplements, Inc.’s products very seriously. Publishing defamatory and false information on a Web site injures the reputation of the IMS Supplements, Inc.. These sites are clearly capitalizing and allowing capitalization on the popularity of the product name and trademark. Some of these web sites went on to suggest that they sell the product Best Prostate®, however as a seller, they are ultimately responsible for the legality of any item that they offer for sale and the listing describing that item. 

Erroneous information posted on the web site constitutes libelous conduct actionable at law. In addition many of these sites violated the Digital Millennium Copyright Act (“DMCA”) by directly copying both photographs and actual content from IMS Supplements, Inc. web sites. 

IMS Supplements, Inc. demanded removal of all defamatory, fraudulent representation, and misleading information concerning the ingredients and specifications of IMS Supplements, Inc.’s product Best Prostate® from these sites.

Many web sites make illegal treatment claims, efficacy claims, and safety claims in violation of US Food and Drug Administration (FDA) regulations regarding dietary supplements.

Product reviews provided on many web sites are inconsistent and contain false, misinformation and confusing subjective comparisons that mislead the consumer. In addition these product reviews contain representations that are false, misleading, and deceptive and are illegal under state and federal laws. We urge consumers to report web sites that deceptively mislead the consumer and make false claims to the Federal Trade Commission.

When I am swallowing the pill I expect forthright transparent honesty and you should too.

We would like to address any false allegations, and provide additional information, that have been published about our product Best Prostate. In addition we wish to thank our customers for drawing these allegations to our attention.

My name is Scottie Jack, and I am the CEO of IMS Supplements, Inc. formerly Nature’s Healthy Supplements, Inc. My background includes work in technology for over 30 years launching new technologies for companies like AT&T, Verizon, Nextel, and Internet start-ups IdeaLabs and Black Arrow, that help companies improve customer service and rapidly deliver new products and services to the marketplace. I have spent the last 10 years launching companies on the Internet to deliver retail products and services to consumers. My education includes Arizona State University where I majored in Finance. On March 11, 2004, I registered the web site www.bestprostate.com.  Previously I was in a partnership with another company that offered a prostate supplement that was manufactured in the form of caplet (compressed tablet shaped like a capsule).  Due to mitigating circumstances beyond my control my affiliation with the other company ceased. 

In 2007 IMS Supplements, Inc. (formerly Nature’s Healthy Supplements, Inc.) was formed with Mr. Cady due to his experience and educational background in the pharmaceutical industry. Mr. Cady spent 28 plus years in the pharmaceutical industry: 18.5 years Bristol-Myers Squibb, 2 years Pharmacia/UpJohn/Pfizer, 7+ years for Merck/Serono. His background includes Pre-med, Organic Chemistry, In-organic Chemistry, Biochemistry, and Microbiology. He is a published author with an article in Organic Chemistry. He is a graduate of Montana State University, Bozeman, MT.

In working with the large U.S. Pharmaceutical manufacturers he discovered that a majority of U.S. Pharmaceutical revenue, approximately 60 to 70 percent, is generated from the North American continent.  This fact signaled that on other continents the medical community was not relying solely on U.S. pharmaceutical products.  By looking into different disease states such as BPH or enlarged prostate he discovered that physicians were prescribing natural products as a form of treatment.  The next logical question was how effective were these natural ingredients?  A review of the medical literature discovered that the efficacy of these natural ingredients was published in the same medical journals that report on the efficacy of prescription medications.  It was obvious that these natural products worked just as well as their prescription equivalents but without the side effects and other unknown long-term health risks of synthetic pharmaceutical compounds.   After reviewing other prostate products currently on the market at that time, we found that none of them were produced using a vegetable capsule in 2007.  They all had a list of un-natural or “other ingredients” like di-calcium phosphate, magnesium stearate, stearic acid, magnesium silicate, silica, silicon dioxide, etc.  The decision was made to produce the product Best Prostate and to make the product without binders, fillers, and un-natural excipients or lubricants commonly found in the manufacturing process of both dietary supplements and prescription medications.  In 2007, Nature’s Healthy Supplements, Inc. launched our Best Prostate.    

Our web site www.bestprostate.com has evolved and where incorrect, confusing, or misinformation was discovered we have made changes. In addition IMS Supplements, Inc. (Nature’s Healthy Supplements, Inc.) participated in a voluntary review of our web site www.bestprostate.com for truth in advertising through the appropriate governing agency. This review process was a 6 to 9 month process. Each and every sentence was examined for the truth, and whether or not it may miss-lead a consumer.
